Udu Council Chief Dragged To Court

The vice chairmanship candidate on the platform of Peoples Democratic Party (PDP) in the last local government election in Udu Council of Delta State, Honda Gometi, has dragged the council Chairman, Dr. Henry Sakpra, to an Otor-Udu High Court for refusing to swear him into office.

In a suit filed at Otor-Udu High Court with suit N0. OUHC/46/08, Gometi as plaintiff, while Sakpra, Emmanuel Masheni, Delta State Independent Electoral Commission (DSIEC) and Peoples Democratic Party (PDP) as 1,2,3 & 4th defendants, respectively.

The plaintiff, in paragraph 12 & 5 of the affidavit, is seeking a declaration that he be sworn in as the vice chairman, being the running mate at the time of the election.

He claimed in the affidavit that he was duly sponsored by PDP, and cleared by DSIEC together with Sakpra on April 24, 2008 in form DSIECF003 to contest the election held on May 10, 2008.

The plaintiff, Gometi, in paragraph 3 & 4 of the affidavit of the originating summons, is seeking an order annulling the swearing in of one Emmanuel Masheni, the 2nd defendant as the vice-chairman for he was not sponsored by PDP, and never a candidate at the time of the election, having been disqualified by DSIEC on April 24, 2008 on the ground that "Not sponsored by PDP in the statutory form DSEC 002".

In a counter affidavit by the 2nd defendant, in paragraph 8, Masheni agreed that he was really disqualified by DSIEC on the ground that he was not sponsored by PDP in the statutory form DSEC 002, but was nominated by the chairman who had the exclusive right to nominate him as running mate without the sponsorship of a political party. These were contained in an appeal he wrote to DSIEC on May 2, 2008 and marked Exhibit D in the affidavit.
