Court Grants Ribadu Leave To Enforce Rights

A Federal High Court on Thursday granted leave to former Chairman of the Economic and Financial Crimes Commission (EFCC), Nuhu Ribadu, to enforce his fundamental human rights.

This followed a motion ex-parte he brought asking the court to stop the police and EFCC from inviting or arresting him pending the determination of the suit.

Ribadu, through his counsel, Tayo Oyetibo (SAN), is also asking the court for a declaration that EFCC, police, and the Attorney General of the Federation (AGF) are not entitled in law to deprive him of his fundamental rights to liberty and freedom of movement.

They also lacked the power, he prayed the court, to interfere in any manner whatsoever with the enjoyment of his rights as guaranteed by sections 35 (1) of the Constitution on account of his failure to attend the office of the 1st respondent (EFCC) pursuant to the invitation contained in its letter dated October 23 and which was communicated to him by the 2nd respondent (Inspector General of Police) vide a letter dated October 24.

He is also seeking "a declaration that by virtue of the provisions of section 41 (1) of the Constitution of the Federal Republic of Nigeria 1999, the 1st respondent is not entitled in law to compel the applicant to attend the office of the 1st respondent in pursuant of the 1st respondent's letter dated 23rd October 2008 which was communicated to the applicant by the 2nd respondent vide letter dated 24th October, 2008.''
