Haruna Knows Fate On Bail Application TodayBy Alexandra Mede, Snr. Correspondent, AbujaFormer Governor of Adamawa State, Boni Haruna, now standing trial before a Federal High Court sitting in Abuja over allegations of theft of N93.9 million while in office, will today know his fate on whether the court will admit him to bail or not. Haruna and his former Special Adviser, currently a member of Adamawa State Houseof Assembly, were on Tuesday arraigned before the court by the Economic and Financial Crimes Commission (EFCC) on a 21-count charge of criminal conspiracy and alterations. At the resumed hearing of the application for the bail on Thursday, counsel to the accused persons, Ricky Tarfa (SAN), had urged the court to admit his clients to bail as according to him, the issue of bail is a right as guaranteed by the 1999 Constitution. "We have the formal application for bail of the 1st accused person (Haruna) on August 4 and that of the 2nd accused person on August 5 pursuant to section 118 (2) of the Criminal Procedure Act (CPA) and under the inherent jurisdiction of this court. "The main issue for determination here is whether in the exercise of its discretion by this court, that the accused persons should not be granted bail. "The 1st accused person was a two term governor of Adamawa State and the 2nd accused person is presently the Minority Leader of the state's House of Assembly," Tarfa added. He maintained that "by this standard, they are both prominent Nigerians who should be granted bail without fear. "Moreover their right to bail is a constitutional one as enshrined under Section 35 and36 of the 1999 Constitution. The accused persons are presumed innocent under the Constitution until proven otherwise. "The onus is on the prosecution to give cogent reasons why they should not be admitted to bail. I urge the court to grant the accused persons bail to enable them have adequate medical attention" he added.
